TAX INCENTIVES IN SPAIN 

TAX REFUNDS FOR INTERNATIONAL FILMING PROJECTS

• Tax benefits for international audiovisual shoots. The benefits of tax rebates oscillate between 20% on general regulation and 40% in the Canary Islands, a measure that will soon be applied in the region of Navarra. It's important to know that the film production company must be settled in Spain in order to apply for the benefits. To achieve these incentives there are many factors to consider:

• The film has to get a cultural interest certificate and a Spanish nationality.
• A copy of the film has to be given to the Spanish Film Archive.
• The minimum spending in the country couldn't be less than one million euros.
• It is necessary to employ local staff.
• The Spanish film production services company must be registered in the Film and Audiovisual Arts Institute (ICAA).
• The refund must be requested a year after shooting/filming, in July.
• The maximum refund is 3 million euros.

TAX INCENTIVES IN THE CANARY ISLANDS

• The Canary Islands have special tax incentives that go up to 40% refunds. These attractive conditions are due to their location. Considered an insular and outlying territory by the European Commission, the islands have the best tax rebate for a film:

• The maximum refund is 4,5 million euros.

• The beneficiaries must be companies settled in that territory and registered in the Film and Audiovisual Arts Institute (ICAA).

• All of the requirements are explained in the Tax Deduction for Investment in Film Production, Series, Live Performances, and Musical Shows (Article 36.1) Law 27/2014, November 27th, about Corporation Tax.

• Other regional communities like Navarre or the Basque Country, offer a 35% deduction via tax credit or tax rebate. They have a regional law that regulates taxes:
• The beneficiaries are companies established in Basque territory and registered in the Film and Audiovisual Arts Institute (ICAA).

• The shooting time should be at least one week.

• If the tax incentive is not enough to cover the amount of the tax credit, the remaining amount can be deduced in the next 15 years.
