What tax deductions can be obtained for an audiovisual project made in Barcelona?

  • Barcelona, ​​and by extension Catalonia, is subjected to the same tax regime as Spain (with the exception of some Spanish territories, like in the Canary Islands, Navarra and the Basque Country). Therefore, the rule applied is article 36, sections 1 and 2, of the November 27th Law 27/2014 about Corporation Tax, which establishes the criteria to be eligible for tax benefits aimed at Spanish and foreign film production services that take place in Spain. What subsidies can the film companies obtain for their project in Barcelona?

  • The Catalan Institute of Cultural Companies establishes the specific bases to get subsidies for a film project each year. In 2018, the categories the production company could choose from were:
  • -Subsidies for short films production services.
  • -Subsidies for fiction feature films production services.
  • -Subsidies for audiovisual works destined to be broadcast on television.
  • -Subsidies for animation production services.
  • The subsidies for short films granted by the Catalan Institute of Cultural Enterprises are given by means of competitive tendering, defined in Law 38/2003, article 22.1 of November 17, general of Subsidies. The choice system compares the submitted applications, picking the ones that obtain the highest evaluation according to the agreements established in the call. The selection process will use the same criteria on all applications, therefore, every project has the same opportunities.

What subsidies are granted for the filming of short films?

  • The subsidies for the production of short films will be granted to independent audiovisual services companies registered in the 'Registry of Audiovisual Companies of Catalonia', in the 'Cinematography and Audiovisual Arts Institute' (ICAA) or in other European Union film registry. An independent audiovisual company is: a natural or legal person that has a legal personality different from a company that provides audiovisual communication services, also, it doesn’t directly or indirectly participate in more than 15% of the capital assets in one or several providing audiovisual communication services companies; that its social capital does not have a direct or indirect participation of more than 15% in one or more providing audiovisual communication services companies; and that in the last three financial years it has not invoiced more than 90% of its turnover volume to the same provider of audiovisual communication services. A provider of audiovisual communication services is understood to be the natural or legal person who assumes the editorial responsibility of the radio or television service, the audiovisual content in question and its broadcasting or broadcasting trough a third party.
  • The requirements to qualify for grants, apart from those established in the general base, are the following:
  • a) The short film will have a regulated start and end period, which must be brought to the knowledge of the Catalan Institute of Cultural Companies in the terms also established in the previous agreement.
  • b) The applicant company must be in charge of the executive producer of the project, in such a contractual way, the executive producer will depend only on it. Likewise, the expense corresponding to the applicant company's share of the whole project must be invoiced in the name of such a company.
  • c) The short film will aim for its broadcast in commercial theaters and participate in festivals, film contests and cinematographic samples in its original qualification version or in the version determined in the corresponding regulatory base.
  • d) Short films in digital format must include, at least, the dubbed or subtitled version in Catalan.
  • e) None of the members involved in the film project can have prior or current sanctions or court sentences for having exercised or tolerated discriminatory labor practices concerning sex or gender.
  • Only the production costs of the short film will be subsidized, as indicated in the regulatory bases of the State Aid and the Administrative Registry of Cinematographic and Audiovisual Companies.
  • The amount of aid, the needed paperwork, the assessment criteria and the method of payment are established each year by the Board of Directors of the Catalan Institute of Cultural Enterprises; which is published in the Official Gazette of the "Generalitat of Catalunya".

  • What subsidies are granted for the filming of fiction feature films?

  • Grants for fiction feature films services in Barcelona are divided into three categories:
  • a) Auteur filming projects and debut films or a new director's second feature film.
  • b) Auteur filming projects that have a commercial purpose.
  • c) Film projects with high internationalization capacity.

  • The recipients are the same as the ones mentioned in the category above (subsidies for short film productions).
  • The requirements to apply for the aid are:
  • a) The filming of the audiovisual work will have a start date, as established in each year's Agreement. If the filming hasn't started at the time of submitting the application, the film production company must inform the Catalan Institute of Cultural Companies about the new filming starting date (in a period no longer than 15 days) and the end of filming date in a period no longer than 30 days.
  • b) As in subsidies for the production of short films, the applicant company must carry out the executive production of the filming, and the executive producer must depend on it contractually. Likewise, the expenses corresponding to the contribution of the applicant company to the whole project must be invoiced in the name of such company.
  • c) Co-productions where the participation of the applicant filming company is just financial are not admitted.
  • d) Three newly graduates in film or audiovisual studies must take part in the filming, with an apprentice contract.
  • e) Audiovisual film works in digital format must include, at least, the dubbed or subtitled version in Catalan.
  • f) The audiovisual work must be completed within the period established in the published agreement.
  • g) The feature film must be premiered in Catalonia's cinema theaters in maximum nine months after the presentation of the accounting expenses sheet.
  • h) A budget is established in each agreement for each modality the filming company may choose.
  • i) The film must exhibit in the number of Catalonia's commercial cinemas established in each Agreement.
  • j) A minimum investment in promotion and publicity must be made for its commercial premiere in movie theaters of the Spanish State, the amounts are specified in each agreement.
  • l) Applicants may request a grant for one feature film per call, or for a maximum of two feature films per call if at least one of these is a fiction film made in a co-production with other national or international filming productions companies.

  • The specific requirements in each modality are the following:
  • -For market-based auteur projects, you must have a marketing strategy that includes the release of the feature film in Spain and Catalonia showrooms, with special attention in the incorporation of new distribution technologies.
  • -For projects with high internationalization capacity, a marketing and launch plan must be available.
  • The eligible costs are those generally foreseen for the production of audiovisual works. The amount, documentation to be presented, evaluation criteria and payment method will be established each year by an agreement of the Board of Directors of the Catalan Institute of Cultural Companies, published in the Official Gazette of the Generalitat de Catalunya.

  • What subsidies are granted to the production of audiovisual works destined to be broadcast on television?

  • Two kinds of audiovisual works destined to be broadcast on television can be eligible for subsidy: one is the production of miniseries or television fiction feature films, and the other is the production of documentaries destined to be broadcast on television.

  • The differentiating requirements that must be fulfilled in this modality, apart from the already expressed, are:
  • a) To have an ongoing contract or a commitment letter from a widespread Catalonian television channel holding's owner, this document should indicate the amount of contributions.
  • b) Having at least 50% of the filming project guaranteed, and proof of it, at the moment of the request of the grant. The filming financing could come from: prior agreements, commitment letters or contracts with companies holding public or private television channels, or from other film distribution companies with other exploitation windows: co-producers (national, international or financial), private financing resources, public subsidies, bank loans for the production of the film, as well the production company's own resources if they are duly accredited.
  • e) A maximum period of time in the making of the film production is fixed in each Agreement.
  • The grant will not be compatible with other grants designated for the same purpose when given by the Catalan Institute of Cultural Enterprises, but will be compatible with other grants given by the Department of Culture of the Generalitat of Catalonia or other organizations that depend on it, as well as other public or private entities.
  • As expressed in other categories, the eligible expenses are those foreseen in general for the production of audiovisual works. The amount, documentation to be submitted, evaluation criteria and method of payment will be established each fiscal year and explained in the agreement of the Board of Directors of the Catalan Institute of Cultural Enterprises, which is published in the Official Gazette of the Generalitat de Catalunya.

What subsidies are granted for the production of audiovisual animation works?

  • The subsidies for the filming of audiovisual animation works are granted according to the following modalities:
  • a) Animation series to be broadcast on television.
  • b) Animation feature films that use and highlight the artistic and technical values ​​of the Country, as well as the diversity of Catalan cinematography.
  • c) Have a commitment letter from a company that operates in a Catalonia's broadcast television channel, or a letter from a video-on-demand platform accessible in Spanish territory. This letter must specify the amount of their respective contribution to the filming project.
  • d) The animation filming project must be completed within a maximum period of time determined by the agreement.
  • In addition, animated feature films must meet the following requirements:
  • a) The content of the project can not derive from any television series that has already been produced.
  • b) The filming project must have a minimum guarantee of financing, stipulated in the agreement.
  • c) There must be a marketing and launch plan for the audiovisual work.
  • d) The audiovisual work must be completed within the periods stipulated in the agreement.
  • As in other categories, the eligible expenses are those generally foreseen for the production of filming services in Barcelona; the amount, documentation to be submitted, evaluation criteria and method of payment will be established each year in the Agreement of the Board of Directors of the Catalan Institute of Cultural Enterprises, published in the Official Gazette of the Generalitat de Catalunya.
