What tax deductions can be obtained for a film production service made in Madrid?

• Madrid’s Community has the same tax deductions than the rest of the Spain, with the exception of the Canary Islands, Navarre and the Basque Country. The tax regulation regarding film services is regulated by rule 36 in sections 1 and 2 of the November 27th Law 27/2014 about Corporation Tax. This tax law establishes the criteria for a company to be eligible for tax benefits regulated in the regime for Spanish and foreign audiovisual productions that take place in Spain, find more detailed information in: Spain.

• We highlight two mandatory requirements for Spanish productions made in Spain: obtaining the Spanish Nationality Certificate, and delivering a new mint condition copy of the film to the Spanish National Film Archive (or another entity established by the Community of Madrid).

• Tax benefits may also be applied to foreign productions of feature films and other audiovisual works. The producer's company, regardless of their nationality, must be registered in the Cinematographic Companies Registration of the Spanish Education, Culture and Sports Ministry. They also have to comply with some obligations regulated in the Law.

What can film production services companies obtain for their audiovisual productions in the Community of Madrid?

• The Community of Madrid aids film production projects in its territory to promote its landscape and heritage by filming audiovisual works with cultural interest and outstanding artistic quality. Your film service company could benefit from any of these aids.

• Annually, the Community of Madrid publicizes grants for film production services companies, aimed at the development and promotion of feature and short films, establishing the amount of aid and the application period for each call. These aids are compatible with others your company may have( granted by public administrations or private entities) unless there is a specific incompatibility expressed in some of the other aids' regulatory bases. The producer's company can choose one or more categories to apply for an aid.

• Production of short films: whether your film production service company wants to make a short fiction film, an animation film or a documentary, the final result must necessarily come in a cinema format. The aid can be requested by an individual or a legal service company whose purpose is to film audiovisual projects. In the evaluation criteria, these elements will be taken into account: the cultural interest, the script, historic memory, the newness and originality of the project, its link with the Community of Madrid as well as the viability of the project, its suitability to the budget, and the production service and financing plan.

• Likewise, the professional career of the production service company and its crew, the productions carried out and their impact will be considered as well as the cinematographic training of the director, scriptwriter and technical and artistic teams.

• Production of feature films for your service company: the owners of independent production service companies that request the subsidy, must prove a minimum of two years of audiovisual activity, a minimum of hired crew and an accredited professional career in the last three years. International co-productions must be admitted by the Cinematography and Audiovisual Arts Institute. Non-profit entities or groups of individuals that do not have their own legal company may not be submitted.

• Development of feature films for your service company: which subsidize the development of fiction, documentary or animation feature film projects that can be materialized in an audiovisual work for public exhibition. The aid can be requested by an individual or legal service company that are holders of independent production companies with a residence in a European Union State. The company must have an audiovisual or cinematographic activity of at least two years prior to the date of the application.

• The expenses associated with the production service company of the feature film before its shooting will be financed, including screenplay improving costs, location search, casting, management financial resources, distribution plans, third party advice on technological aspects of the project, acquisition of rights and archive investigation, elaboration of the graphic script, elaboration of the budget and other arrangements related to the film development.

• These grants will be compatible with others the production company may have, whether private or public, if the total of the subsidies received by that company, plus the amount granted by the Community of Madrid, does not exceed one hundred percent of the cost of the budgeted film.

Other requirements to consider are:

• 1. In the case of co-productions, only the one that has the higher percentage may be a beneficiary of the aid.

• 2. The projects submitted to the call must have at least 10% of the funding needed to cover the total cost of the film production project, in accordance with the budget that has been submitted

• 3. The projects that at the time of the aid request have already started shooting will not be able to access the aids.

• Creation of the script. The aim is to promote creativity in the field of cinematography. The Madrid Community residents may apply for this assistance. It must have been written by a new author, meaning that he has not published, released or professionally displayed more than three film projects. In cases of co-authorship, all the authors of the project will be considered beneficiaries of the aid, and those who have obtained it in one of the two preceding aid calls will not be able to opt for it.

• The applicant individual or applicant company must submit a project with a report, a synopsis and a sequenced treatment. The cultural interest, the design of elements, the expository clarity, the contribution to the current enrichment of the creation, its originality and innovation will be valued. The professional merits, the previous works and their repercussion will be also taken into account.

Can non-profit entities obtain grants for the production of audiovisual works?

• For those who own a non profit company, the answer is yes, as long as they meet three requirements:
• 1º. Be enrolled in the regional or national Register for at least two years.
• 2º. Carry out the subsidized film activity in the Madrid’s Community territory. This activity should be related to cinematography.
• 3º. Not to be a beneficiary of another subsidy the same year of the aid for the audiovisual production service request.
• The film production project must be carried out in the computable period indicated in the call, attaching a budget sheet with expenditure and financing. A report of the cultural activities carried out in the two previous years will be attached. The expenses of maintenance and ordinary operation of the entity, including meals and representation expenses, will not be subsidized.
